What is personal data?
GDPR, considers “personal data” any information about an identified or identifiable natural person (“data subject”). An identifiable natural person is a person who can be identified, directly or indirectly, in particular by reference to an identification element, such as a name, identification number, location data, an online identifier or to one or more specific elements, specific to its physical, physiological, genetic, psychological, economic, cultural or social identity.
There is no list of personal data, and the GDPR does not require states to make such a list, for the simple reason that a date may become in a given context of a personal nature, and in another context it may simply be a information without personal data value.
Here are some examples of personal data:
name; one’s domicile or residence; an e-mail address (including addresses of type ion.popescu@yahoo.ro); ID number, passport or ID card; location data (for example, the location data feature available on a mobile phone) *; an IP; a cookie ID; the silhouette of someone from the CCTV recordings; a registration number of a car;
At the same time, however, to exemplify the time when an information may or may not be a personal date, if we assume that a person finds on paper a paper on which the sum of 4,930 lei is written, without any other helpful information, then that information is impossible to relate to a particular person. If, however, someone finds on paper a paper on which the sum of 4,930 lei is written, with the mention that it is a salary from the company SC X SRL, then someone, if they do an investigation and manage to put together information (including by talking to the HR department of the company in question), they might find out that that salary belongs to a certain person in the company. In that context, the information becomes personal data (because it refers to an identifiable person).
As can be seen, the definition of personal data contains several important elements:
Personal data refers to information about individuals, not legal entities. The distinction is important because, for example, the registration number from the Trade Register, the Tax Code or other identification elements of some companies are not personal data. Moreover, when an e-mail address or telephone number clearly targets a legal person (eg office @ emails or phones from a public call center of a company), then we are not talking about personal data.
It does not matter if the processing of this personal data is done through an automatic system or through a non-automated system (eg manual processing), if it is part of a structured data record system. The only important thing is that we are talking about processing such data.
More information for understanding what personal data is can be obtained by reading Opinion no. 4 of 2007 regarding the concept of personal data, issued by the Article 29 Working Group.
By simplifying the definition above, we could conclude that personal data means data that refers to a living person that can be identified:
using this data; or starting from these data and using additional information that is or may be in the possession of the data operator.
